General Terms and Conditions of Sale

Art. 1 - General Provisions

1. The user browsing in this area will arrive at Red Moringa, accessible at the URL: redmoringa.eu Browsing and placing an order on the website imply acceptance of the terms and privacy policies stated on the website.

2. These General Terms and Conditions of Sale exclusively apply to the sale of products in accordance with the provisions of Part III, Title III, Chapter I of the Consumer Code (Legislative Decree No. 206/05, as amended by Legislative Decree No. 21/14 and Legislative Decree No. 70/03), carried out by the following company:

3. The user is required to read these General Terms and Conditions of Sale before accessing the products offered by the website, which are generally and unequivocally deemed accepted once the purchase is made.
4. It is recommended that the user downloads and prints a copy of the order form and these General Terms and Conditions of Sale, as Red Moringa reserves the right to unilaterally amend the terms without prior notice.

 Art. 2 - Subject

1. The present General Terms and Conditions of Sale regulate the offer, transmission, and acceptance of orders for products on Red Moringa and do not govern the provision of services or the sale of products by other providers represented through links, banners, or other hyperlinks on the same website.
2. Before placing orders and purchasing products and services from other providers, we recommend that you review their terms of sale.

Art. 3 - Conclusion of Contract

1. To conclude the purchase contract, the electronic form must be filled out and submitted according to the corresponding instructions.
2. It contains references to the General Terms and Conditions of Sale, images of each product, the corresponding price, accepted payment methods, delivery terms of the purchased products, as well as the associated shipping and delivery costs, a reference to the terms for exercising the right of withdrawal, and the procedures and deadlines for returning purchased products.
3. Before concluding the contract, confirmation of having read the General Terms and Conditions of Sale, including the information on the right of withdrawal and the processing of personal data, is requested.
4. The contract is concluded when the seller receives the form filled out by the user, after verifying the accuracy of the data contained therein.
5. The buyer is obligated to pay the price once the online ordering process is completed. This is done by clicking on the "Complete Order" button at the end of the guided process.
6. After the contract is concluded, the seller takes over the processing of the order.

Art. 4 - Registered Users

1. In completing the registration procedures, the user undertakes to follow the instructions on the website and to provide their personal data correctly and truthfully.
2. The confirmation will in any case exempt Red Moringa from any responsibility regarding the data provided by the user. The user undertakes to promptly inform Red Moringa of any changes to their data communicated at any time.
3. If the user communicates inaccurate or incomplete data, or if there is a dispute from the parties concerned regarding payments made, Red Moringa shall have the right not to activate or to suspend the service until the relevant deficiencies are rectified.
4. Upon the first request for activation of a profile by the user, Red Moringa will assign a username and a password. The user acknowledges that these identifiers constitute the validation system for accessing the Services and the only system suitable for identifying the user. Acts performed through this access will be attributed to the user and will be binding on them.
5. The user undertakes to keep their login data confidential and to handle them with due care and diligence, and not to temporarily transfer them to third parties.

Art. 5 - Availability of Products

1. The availability of the products refers to their actual availability at the time of the order by the buyer. However, this availability must be considered purely indicative, as due to the simultaneous presence of multiple users on the website, the products could be sold to other customers before the order confirmation.
2. Even after the shipment of the order confirmation email, cases of partial or complete unavailability of the goods may occur. In this case, the order will be automatically adjusted by removing the unavailable product, and the buyer will be promptly notified via email.
3. If the buyer requests the cancellation of the order and terminates the contract, Red Moringa will refund the amount paid within 15 days from the time Red Moringa becomes aware of the buyer's decision to terminate the contract.

Art. 7 - Payment Methods and Prices

1. The price of the products is indicated on the website, unless obvious errors are present
2. In case of an obvious error, Red Moringa will notify the buyer as soon as possible and allow them to confirm the order at the correct price or cancel it. However, Red Moringa is not obligated to provide the product sold at the mistakenly lower price.
3. The prices on the website include value-added tax (IVA) and do not include shipping costs. Prices are subject to change at any time. However, these changes do not affect orders for which an order confirmation has already been sent.
4. After selecting the desired products, they are added to the shopping cart. It is sufficient to follow the instructions for purchase by entering or reviewing the required information at each step of the process. Order details can be changed before payment.

Art. 8 - Delivery

1. RedMoringa ships cosmetics throughout Europe, while supplements are only shipped to France, Germany, Italy, and Bulgaria and only to those that have been properly notified to the respective Ministries. Each product is enabled or disabled for sale depending on the shipping address entered at checkout.
2. Red Moringa delivers exclusively to the address provided by the user at the time of purchase.
3. The delivery in Italy usually takes place within 2-4 working days, or, if no delivery date is specified, within the estimated timeframe indicated when selecting the delivery method, and in any case within a maximum of thirty days from the confirmation date.
4. For countries within the European Union, delivery takes place within 5-7 working days, and in any case within a maximum of thirty days.
5. If delivery is not possible, the order will be sent back to the warehouse. In this case, a notification will indicate the location of the order and provide the opportunity to arrange for a new delivery.
6. If you are unable to be present at the delivery location at the agreed time, we kindly ask you to contact us again to arrange a new delivery date.
7. If delivery cannot be made for reasons beyond our control, and thirty days have passed since the date the order is ready for delivery, we will assume that you wish to terminate the contract.
8. In the event of contract termination, the amounts will be refunded, including delivery costs, except for any additional costs resulting from the choice of a delivery method that deviates from the ordinary method offered, without undue delay and in any case within 15 days from the date of contract termination. The costs of returning the goods due to contract termination may be borne by the buyer.
9. The buyer bears the shipping costs, which are expressly indicated at the time of ordering.

Art. 9 - Transfer of Risk

1. The risks related to the products pass to the buyer from the moment of delivery. Ownership of the products is considered acquired once full payment of all due amounts related to these products, including shipping costs, has been received, or in the case of later delivery, at the time of delivery itself.

Art. 10 - Warranty and Commercial Compliance

1. The seller is responsible, in accordance with the provisions of Italian law, for any defects in the products offered on the website, including non-conformity of the items with the ordered products.
2. If the buyer has entered into the contract as a consumer, i.e., any natural person acting on the website without doing so within the scope of their commercial or professional activity, this warranty applies if the defect occurs within 24 months from the delivery date of the products; the buyer submits a formal complaint within a maximum of 2 months after discovering the defect; the online return form is properly filled out.
3. In case of non-conformity, the buyer who has entered into the contract as a consumer has the right to free restoration of the conformity of the products through repair or replacement, or to an appropriate price reduction, or to termination of the contract with respect to the disputed goods and the corresponding refund of the price.
4. All return costs for defective products will be borne by the seller.

Art. 11 - Withdrawal

1. According to the applicable legal provisions, the buyer has the right to withdraw from their purchase contract within 14 days of receiving the products without giving any reasons and without penalty, in accordance with Article 57 of Legislative Decree 206/2005."
2. For multiple purchases made by the buyer in a single order and delivered separately, the withdrawal period starts from the receipt of the last product and lasts for 30 days.

1. The buyer must also exercise their right of withdrawal by providing an explicit statement in which the decision to withdraw from the contract is communicated, or alternatively by submitting the optional withdrawal form according to Annex I Part B of Legislative Decree 21/2014.

1. The goods must be returned intact in the original packaging, complete with all parts and accompanying tax documentation. Subject to the possibility of verifying compliance with the above conditions, the website will refund the amount for the returned products within a maximum period of 15 days, including any shipping costs.
2. In accordance with Article 56(3) of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014, the website may suspend the refund until the goods are received or until the buyer provides proof that the goods have been returned.
3. The right of withdrawal does not apply to services and products from Red Moringa falling within the categories of Article 59 of Legislative Decree 206/2005. This category includes all food supplements, food products, and certain types of food containers.
4. The website will issue the refund using the same payment method chosen by the buyer at the time of purchase. In the case of payment by bank transfer and if the buyer wishes to exercise their right of withdrawal, they must provide the bank details: IBAN, SWIFT, and BIC, required for the refund.

Art. 12 - Data Processing

1. The buyer's data will be processed in accordance with the provisions for the protection of personal data, as outlined in the corresponding section of the privacy policy pursuant to Article 13 of EU Regulation 2016/679. (Privacy Policy) explained in more detail.

Art. 13 - Protection Clause

1. If any clause in these General Terms and Conditions is declared null and void for any reason, this shall not affect the validity and compliance of the other provisions in these General Terms and Conditions.

Art. 15 – Applicable Law and Competent Court

1. These General Terms and Conditions are governed by Italian law and will be interpreted in accordance with it, unless mandatory provisions of the country of habitual residence of the buyer oppose them. Therefore, the interpretation, execution, and termination of the General Terms and Conditions are subject exclusively to Italian law.
2. Any disputes relating to these terms or arising therefrom must be settled exclusively before the Italian courts. In particular, if the buyer is a consumer, any disputes must be settled before the court at their place of residence in accordance with applicable law.
