General Terms and Conditions of Sale
Art. 1 – General provisions
By browsing this area, the user accesses RedMoringa, available at the URLs: https://redmoringa.it/en/ and https://redmoringa.eu/. Browsing and submitting a purchase order on the site entail acceptance of the Conditions and of the Data Protection Policies adopted by the site as indicated therein.
These General Terms and Conditions of Sale apply to the sale of products exclusively with reference to purchases made on the site in accordance with the provisions of Part III, Title III, Chapter I, of the Consumer Code (Legislative Decree no. 206/05, as amended by Legislative Decree no. 21/14, Legislative Decree no. 70/03 and Legislative Decree no. 209/2025) by:

Before accessing the products provided by the site, the user is required to read these General Terms and Conditions of Sale, which are deemed to be generally and unequivocally accepted at the time of purchase.
The user is invited to download and print a copy of the purchase form and of these General Terms and Conditions of Sale, the terms of which RedMoringa reserves the right to amend unilaterally and without prior notice.
The site and the products provided through it may be used and purchased in the following languages: Italian, English, German, French.
Art. 2 – Subject
These General Terms and Conditions of Sale govern the offer, submission and acceptance of purchase orders for products on RedMoringa and do not govern, however, the provision of services or the sale of products by parties other than the seller that are present on the same site through links, banners or other hyperlinks.
Before submitting orders and purchasing products and services from other parties, we suggest checking their conditions of sale.
Art. 3 – Conclusion of the contract
To conclude the purchase contract, it will be necessary to complete the electronic form and submit it following the relevant instructions.
It contains the reference to the General Terms and Conditions of Sale, the images of each product and its price, the means of payment that may be used, the delivery methods for the purchased products and the relevant shipping and delivery costs, a reference to the conditions for exercising the right of withdrawal — including the indication that, in the event of withdrawal, the costs of returning the products are borne by the buyer — as well as the methods and timing for returning the purchased products.
Before concluding the contract, the user will be asked to confirm that they have read the General Terms and Conditions of Sale, including the Information Notice on the right of withdrawal and on the processing of personal data.
The contract is concluded when the seller receives the form completed by the user, after verifying the accuracy of the data contained therein.
The buyer will be obliged to pay the price from the moment the online order submission procedure is completed. This will occur by clicking the “Place order” button at the end of the guided procedure.
Once the contract is concluded, the seller takes charge of the order for its fulfillment.
Art. 4 – Registered users
When completing the registration procedures, the user undertakes to follow the instructions on the site and to provide their personal data correctly and truthfully.
Confirmation shall in any case release RedMoringa from any liability regarding the data provided by the user. The user undertakes to promptly inform RedMoringa of any change to the data communicated at any time.
Should the user communicate inaccurate or incomplete data, or in the event of a dispute by the interested parties regarding the payments made, RedMoringa shall have the right not to activate or to suspend the service until the relevant deficiencies are remedied.
Upon the user's first request to activate a profile, RedMoringa will assign them a username and a password. The user acknowledges that these identifiers constitute the system for validating the user's access to the Services and the only suitable system to identify the user, and that the acts performed through such access will be attributed to them and will be binding upon them.
The user undertakes to keep their access data secret and to safeguard them with due care and diligence, and not to transfer them, even temporarily, to third parties.
Art. 5 – Availability of products
The availability of products refers to the actual availability at the moment the buyer places the order. Such availability must in any case be considered purely indicative because, due to the simultaneous presence of multiple users on the site, the products may be sold to other customers before the order is confirmed.
Even after the order confirmation e-mail has been sent, cases of partial or total unavailability of the goods may occur. In this event, the order will be automatically adjusted by removing the unavailable product, and the buyer will be immediately informed by e-mail.
If the buyer requests the cancellation of the order, terminating the contract, RedMoringa will refund the amount paid within 14 days from the moment RedMoringa became aware of the buyer's decision to terminate the contract.
Art. 6 – Products offered
RedMoringa markets: Food Supplements, Cosmetics and Food Products based on Moringa Oleifera.

Art. 7 – Payment methods and prices
The price of the products will be the one indicated from time to time on the site, except where there is a manifest error.
In the event of an error, RedMoringa will notify the buyer as soon as possible, allowing confirmation of the order at the correct amount or its cancellation. In any case, RedMoringa shall not be obliged to supply what was sold at the lower price erroneously indicated.
The prices on the site are inclusive of VAT and do not include shipping costs. Prices may change at any time. Changes do not affect orders for which order confirmation has already been sent.
Once the desired products have been selected, they will be added to the cart. It will be sufficient to follow the instructions for purchase, entering or verifying the information requested at each step of the process. The order details may be modified before payment.
Payment may be made via: Cash on delivery, Paypal, Stripe, Credit Card, Satispay, Klarna.
Art. 8 – Delivery
RedMoringa ships cosmetics throughout Europe, while supplements are shipped only to France, Germany, Italy and Bulgaria, and only those that have been duly notified to the respective Ministries. Each product is enabled or disabled for sale depending on the shipping address entered at checkout.
RedMoringa will only make deliveries to the user's domicile, provided at the time of purchase.
Delivery is carried out, for Italian territory, generally within 2-4 working days, or, if no delivery date is specified, within the period estimated at the time of selecting the delivery method and, in any case, within a maximum period of thirty days from the date of confirmation.
As regards the countries of the European Union, delivery will be carried out within 5-7 working days, and in any case within a maximum period of thirty days.
If delivery is not possible, the order will be sent to the depot. In this event, a notice will specify where the order is located and how to arrange a new delivery.
If the user is unable to be present at the place of delivery at the agreed time, we ask them to contact us again to arrange a new delivery date.
If delivery cannot take place for reasons not attributable to us after thirty days from the date on which the order is available for delivery, we will assume that the user intends to terminate the contract.
As a consequence of termination, the amounts will be refunded, including delivery costs but excluding any additional costs arising from the choice of a delivery method other than the standard method offered, without undue delay and, in any case, within 14 days from the date of termination of the contract. The transport resulting from the termination of the contract may entail additional costs that will be borne by the buyer.
Shipping costs are borne by the buyer and are explicitly highlighted at the time the order is placed.
Art. 9 – Transfer of risk
The risks relating to the products will pass to the buyer from the moment of delivery. Ownership of the products is deemed acquired as soon as full payment of all amounts due in relation to them, including shipping costs, has been received, or at the moment of delivery, if this occurs at a later time.
Art. 10 – Legal guarantee of conformity
The seller is liable to the buyer acting as a consumer for any lack of conformity of the products existing at the time of delivery and which becomes apparent within 24 months of delivery, pursuant to Articles 128 et seq. of the Consumer Code (as amended by Legislative Decree 170/2021). The action to assert defects not fraudulently concealed by the seller is time-barred 26 months after delivery of the goods.
“Consumer” means any natural person acting on the site for purposes unrelated to any business or professional activity carried out.
In the event of a lack of conformity, the consumer is entitled to have the conformity of the goods restored free of charge by repair or replacement, or to an appropriate reduction in price, or to termination of the contract, in accordance with the conditions and in the order set out in Articles 135-bis et seq. of the Consumer Code.
To facilitate the handling of the matter, the buyer is invited to report the defect by completing the online return form or by writing to info@redmoringa.it; such report does not, however, constitute a condition for the validity or forfeiture of the legal guarantee.
All costs of returning defective products are borne by the seller.
Art. 11 – Right of withdrawal
Pursuant to the applicable legal provisions, the buyer has the right to withdraw from the purchase contract within 14 days of receipt of the products, without giving any reason and without penalty, pursuant to Art. 52 of Legislative Decree 206/2005 (Consumer Code). In the case of multiple products ordered by the buyer in a single order and delivered separately, the 14-day period begins on receipt of the last product.
The buyer may exercise the right of withdrawal:
• (a) by using the dedicated digital withdrawal function available on the site (the “Withdraw from the contract here” button), accessible throughout the entire withdrawal period, pursuant to Art. 54-bis of the Consumer Code; or
• (b) by sending an explicit statement to info@redmoringa.it, indicating the order number and their details, where applicable using the model withdrawal form set out in Annex I, Part B, of the Consumer Code.
After the withdrawal is exercised through the digital function, the buyer shall receive without delay, on a durable medium (e-mail), a confirmation stating the date and time of receipt.
The goods must be returned to the following address: RedMoringa Srl, Via Capua 19, 10144 Turin, Italy (operational office).
The return costs (return shipping) are borne by the buyer, pursuant to Art. 57 of Legislative Decree 206/2005.
The return must take place without undue delay and in any case within 14 days of the communication of the withdrawal.
The goods must be returned intact, in their original packaging, complete with all their parts and the enclosed tax documentation.
The site will refund the amount for the returned products, including standard delivery costs, within 14 days. Pursuant to Art. 56, paragraph 3, of Legislative Decree 206/2005, the refund may be withheld until the goods are received or until the buyer provides proof of return shipment.
Exceptions to the right of withdrawal (Art. 59 of Legislative Decree 206/2005): the right of withdrawal does not apply to the supply of sealed goods which are not suitable for return for reasons of hygiene or health protection and which were unsealed after delivery, nor to the supply of goods liable to deteriorate or expire rapidly. Food supplements and foodstuffs fall under this exception only if the seal has been opened after delivery; sealed and unopened products may be returned within the time limit.
The refund will be made using the same means of payment used by the buyer for the order. In the case of payment by bank transfer, the buyer must provide the bank details necessary for the refund (IBAN, SWIFT/BIC).
Art. 12 – Data processing
The buyer's data are processed in accordance with the provisions of the legislation on the protection of personal data, as specified in the dedicated section containing the information notice pursuant to Art. 13 of EU Regulation 2016/679 (Privacy Policy).
Art. 13 – Severability clause
In the event that one of the clauses of these General Terms and Conditions of Sale is null and void for any reason, this shall in no way compromise the validity and observance of the other provisions set out in these General Terms and Conditions of Sale.

Art. 15 – Applicable law and competent court
These General Terms and Conditions of Sale are governed by and interpreted in accordance with Italian law, subject to any overriding mandatory provisions of the country of the buyer's habitual residence. Consequently, the interpretation, performance and termination of the General Terms and Conditions of Sale are subject exclusively to Italian law.
Any disputes relating to and/or arising from them shall be resolved exclusively by the Italian judicial authority. In particular, where the buyer qualifies as a Consumer, any disputes shall be resolved by the court of the place of domicile or residence of the same under the applicable law.
Art. 16 – Subscriptions
RedMoringa offers its customers the possibility of subscribing to a subscription service (“Subscription”) for certain products, on a monthly or quarterly basis, depending on the choice made at the time of the order. Activation of the Subscription entitles the customer to exclusive discounts and/or favourable conditions on shipping costs.
Activation and renewal methods. The subscription is activated at the time of purchase by selecting the relevant option on the desired product. The Subscription renews automatically at the chosen frequency (monthly or quarterly), unless cancelled in accordance with the “Cancellation and limitations” section. Payment will be charged automatically at the selected frequency, using the payment method indicated by the user at the time of purchase.
Subscription management. By accessing their personal area (“My Account”), the user may: change the selected product for another of equal value; pause the Subscription; reactivate the Subscription at a later time. All these options can be activated at any time after the second automatic renewal.
Cancellation and limitations. The user may cancel the subscription from the second renewal included. A cancellation request made before the second renewal will not be considered valid, and the user will in any case be required to pay the next installment. This limitation is related to the nature of the economic benefit granted to the user in the first subscription period and forms an integral part of the contractual offer, of which the user takes note at the time of activation.
To cancel the subscription, the user may proceed independently through the “My Account” area or send a written request by e-mail to: info@redmoringa.it.
Service changes. RedMoringa reserves the right to modify the conditions of the subscription at any time, informing users with at least 15 days' notice by e-mail. The user may decide whether to accept the new conditions or cancel the subscription before they become effective.
